RAD RACE TOUR DE FRIENDS JAPAN 2026
For convenience, this disclaimer is provided in both English and German. The German version can be found below. In case of discrepancies between the two versions, the German text shall prevail.
By entering the event site and/or participating in the RAD RACE TOUR DE FRIENDS JAPAN 2026 (“TDF JAPAN 2026”), all participants and visitors accept the following disclaimer and terms of participation.
Liability
Participation in the event takes place at the participant’s own risk. This does not affect the organiser’s liability in accordance with the provisions below.
The organiser (RAD RACE GmbH) shall be liable without limitation
– for damage resulting from intentional acts or gross negligence by the organiser or its legal representatives or vicarious agents, and
– for damage resulting from injury to life, body or health, irrespective of the degree of fault, where such damage is caused by a negligent or intentional breach of duty by the organiser or its legal representatives or vicarious agents.
For other damage caused by simple (ordinary) negligence, the organiser shall only be liable in the event of a breach of essential contractual obligations (cardinal duties). In such cases, liability is limited to the typical, foreseeable damage at the time of conclusion of the contract. Essential contractual obligations are those obligations whose fulfilment is essential for the proper performance of the event and on the fulfilment of which the participant regularly relies.
Any further liability of the organiser is excluded. Mandatory statutory liability (in particular under German product liability law) remains unaffected.
Participants are responsible for ensuring that their level of training and state of health allow safe participation in a multi-day cycling event in Japan (including long distances, climbs, heat, traffic and local conditions). This does not affect the organiser’s liability under the provisions above.
Mandatory Insurance and Proof of Coverage
Participation in TDF JAPAN 2026 is only permitted if the participant has valid insurance cover for the duration of the trip, including the travel to, stay in and return from Japan.
Each participant must, at a minimum, have:
– personal liability insurance, and
– international health insurance (travel health insurance) valid in Japan,
or a travel insurance policy that provides equivalent cover for both personal liability and medical treatment abroad, including emergency treatment and repatriation, and that includes road cycling participation in an organised multi-day event.
Participants must be able to provide written proof of such insurance cover at any time upon request by the organiser. The organiser reserves the right to exclude participants from the event if they are unable to provide sufficient proof of insurance; in such cases, there is no entitlement to a refund of participation fees or other costs.
Compliance with Local Laws and Regulations
Participants are solely responsible for complying with all applicable laws and regulations of Japan and any transit countries. This includes in particular:
– road traffic regulations (including the Japanese Road Traffic Act and local traffic rules),
– public order and safety regulations,
– customs, immigration and visa regulations, and
– any other applicable local administrative or criminal law provisions.
The organiser is not liable for any consequences arising from violations of such laws by participants, including but not limited to fines, penalties, criminal prosecution, detention or deportation.
Participants undertake to indemnify and hold harmless the organiser from any third-party claims, fines, fees, costs or other expenses imposed on the organiser in connection with violations of local laws by the participant, except where the organiser is at fault.
Traffic Regulations and Road Safety
TDF JAPAN 2026 takes place primarily on public roads and in public spaces that are open to general traffic. Participants are required to comply with all applicable road traffic regulations at all times. This includes, in particular, obeying traffic signs and signals, respecting right-of-way rules, and exercising particular care in tunnels, on descents, in urban traffic and on narrow or winding roads.
Failure to comply with these regulations significantly increases the risk of serious injury or fatality. The organiser shall not be liable for injuries to life, body or health that result solely from a participant’s disregard of applicable traffic regulations or instructions given by the police or other authorities.
Rules and Disqualification
Participants agree to follow the rules and regulations determined by the organiser (as published on the organiser’s website and communicated on-site) and to comply with instructions given by the organiser, its staff and guides at all times.
The organiser reserves the right to exclude participants from the event, temporarily or permanently, in particular if:
– safety-relevant instructions are ignored,
– there is a serious or repeated breach of these rules or of this disclaimer,
– required insurance cover cannot be proven, or
– there are serious breaches of local law or behaviour that endangers other participants, staff or third parties.
Environmental Protection Commitment
RAD RACE GmbH actively promotes environmental responsibility across all business activities. Participants and stakeholders are expected to comply with applicable environmental laws and regulations, particularly concerning waste disposal, soil and water protection and pollution control. Proven infringements may result in disqualification and, where applicable, claims for damages.
Force Majeure
In cases of force majeure (such as natural disasters, war, epidemics, decisions by authorities, severe weather, road closures or other events beyond the organiser’s reasonable control) that substantially affect or render impossible the safe execution of TDF JAPAN 2026 or parts of it, the organiser (RAD RACE GmbH) shall not be liable for damages resulting from the cancellation, postponement or modification of the event, except in cases of intent or gross negligence.
Any refund or credit of registration fees in such cases will be handled in accordance with the organiser’s General Terms & Conditions and the applicable statutory provisions.
Media and Image Rights
By participating, participants consent, without compensation, to the use, distribution and publication of photos, videos, sound recordings and interviews made of them in connection with their participation in TDF JAPAN 2026. These materials may be used in various media formats, including radio, television, internet, social media, advertising, books and other media.
Names and other result-related data may be published in result lists on www.rad-race.com and in accompanying media coverage.
Age Verification
Participants must generally be at least 18 years old at the start of the event.
Participants who are at least 16 but under 18 years of age may participate only with the prior written consent of a parent or legal guardian. The signed consent form must be submitted to the organiser before the start of the event. RAD RACE GmbH reserves the right to exclude any participant providing false information regarding their age or other registration data.
Final Provisions
This disclaimer is governed by German law. Mandatory consumer protection provisions of the participant’s home country remain unaffected where they apply.
Should any provision of this disclaimer be or become invalid, the validity of the remaining provisions shall not be affected. In such a case, a valid provision shall apply which comes closest to the economic intent of the invalid provision.
