By entering the event site and/or participating in RAD RACE SUMMERCAMP 2026 (“SUMMERCAMP 2026”), all participants and visitors accept the following disclaimer and terms of participation. The RAD RACE General Terms & Conditions for events apply in addition to this disclaimer. RAD RACE

1. Participation and own risk

1. Participation in SUMMERCAMP 2026 (including all official group rides, gravel rides, runs, lake activities, workshops, parties and all side events) takes place at the participant’s own risk.

2. This principle does not limit the organiser’s liability as set out in section 2 below or mandatory statutory rights of consumers.

2. Liability of the organiser

1. The organiser of SUMMERCAMP 2026 is RAD RACE GmbH (“organiser”).

2. The organiser is liable without limitation:

   • for damage caused intentionally or by gross negligence by the organiser, its legal representatives or vicarious agents, and

   • for damage resulting from injury to life, body or health, where such damage is caused by a negligent or intentional breach of duty by the organiser, its legal representatives or vicarious agents.

3. For other damage caused by simple (ordinary) negligence, the organiser is only liable in the event of a breach of essential contractual obligations (“cardinal duties”). In such cases, liability is limited to typical damage which was foreseeable at the time of conclusion of the contract. Essential contractual obligations are those whose fulfilment is a prerequisite for the proper performance of the event and on which participants regularly rely.

4. Any further liability of the organiser is excluded. Mandatory statutory liability (including, but not limited to, German product liability law) remains unaffected.

3. Health, fitness and personal responsibility

1. Each participant is solely responsible for ensuring that their physical and mental condition allows safe participation in a multi-day cycling, running and outdoor camp including, in particular:

   • long-distance rides to and from the camp,

   • gravel sections,

   • community runs,

   • open-water swimming in a lake,

   • heat, cold, weather changes, and

   • late nights and possible alcohol consumption.

2. Participants are advised to undergo a medical check-up before participating and to follow medical advice.

3. Participants with health issues (e.g. cardiovascular conditions, respiratory problems, epilepsy, recent injuries, or similar conditions) must clarify with a doctor whether participation is safe for them.

4. Participants must immediately inform the organiser or crew if they feel unwell or no longer capable of participating safely.

4. Traffic regulations and road safety

1. SUMMERCAMP 2026 group rides (to and from Berlin/Hamburg) and any rides or runs during the weekend take place on public roads and paths that are open to general traffic.

2. Participants must comply with all applicable traffic regulations at all times (in particular the German Road Traffic Act and Road Traffic Regulations) and must:

   • obey traffic signs, traffic lights and instructions by police or authorities,

   • respect right-of-way rules,

   • ride/run in a controlled manner, especially in groups, on descents, in urban areas and on gravel sections.

3. Participants acknowledge that non-compliance with traffic regulations and instructions significantly increases the risk of accidents and serious injuries.

4. The organiser is not liable for damage to life, body or health that is solely caused by a participant’s disregard of applicable traffic regulations or official instructions, subject to section 2 above.

5. Campground, lake and accommodation

1. SUMMERCAMP 2026 takes place at the Friedensteich Wittenberge camping ground (Wüstenweg 13a, 19322 Wittenberge, Germany). Participants must respect all rules and regulations of the campground operator in addition to this disclaimer.

2. The lake and other natural areas around the campground are not necessarily supervised by lifeguards or safety staff at all times. Swimming and all water activities are undertaken at each participant’s own risk.

3. Participants must behave in a way that does not endanger themselves or others in or around the water, in particular by:

   • refraining from swimming under the influence of alcohol or drugs,

   • respecting marked swimming zones and warnings,

   • not jumping or diving into unknown or shallow water.

4. Participants are responsible for any damage they cause to accommodation (cabins, tents, rental tents, sanitary facilities and other infrastructure) and may be held liable by the organiser and/or the campground operator.

5. The organiser is not liable for theft or loss of personal belongings, including but not limited to bikes, equipment, tents, technical devices, clothing or valuables, unless otherwise required by law or covered under section 2.

6. Equipment, bikes and safety gear

1. Every participant is responsible for ensuring that their bike is in proper, roadworthy and safe condition (frame, brakes, steering, tyres, lights, etc.).

2. Helmets are mandatory on all official rides and strongly recommended when cycling at any time during the weekend.

3. The use of lights and reflective clothing is strongly recommended in low light or poor visibility conditions.

4. Mechanical support and Park Tool School sessions provided on site are intended as voluntary, supportive services only. Participation in such sessions does not transfer responsibility for the roadworthiness of the bike from the participant to the organiser or partner brands.

5. Participants must bring any personal medication and specific safety equipment they require (e.g. allergy medication, orthopaedic aids, etc.).

7. Rules, instructions and exclusion from the event

1. Participants must comply with all rules and information published on the organiser’s website and communicated before or during the event. RAD RACE

2. Participants must follow instructions given by the organiser, crew members, guides, security staff, medical staff and the campground operator at all times.

3. The organiser reserves the right to exclude participants from parts of the programme or the entire event, temporarily or permanently, in particular if:

   • safety-relevant instructions are ignored,

   • there are serious or repeated breaches of rules or of this disclaimer,

   • behaviour endangers other participants, staff or third parties,

   • participants cause significant disturbance (e.g. at night, at the lake, in cabins or tents),

   • participants are obviously under the influence of alcohol or drugs in a way that poses a safety risk.

4. In such cases, there is no entitlement to a refund of participation fees or other costs (e.g. travel, accommodation).

8. Environmental responsibility

1. RAD RACE promotes environmentally responsible behaviour at all events. RAD RACE

2. Participants undertake to protect the nature around Friedensteich, in particular by:

   • avoiding littering and using designated waste and recycling bins,

   • protecting vegetation and wildlife,

   • avoiding unnecessary noise and light pollution,

   • using water and energy resources responsibly.

3. Proven serious or repeated infringements of environmental rules may lead to exclusion from the event and, where applicable, claims for damages.

9. Force majeure and event changes

1. In cases of force majeure (including but not limited to severe weather, storms, floods, fire, natural disasters, epidemics, official orders, road closures or other events beyond the organiser’s reasonable control) that significantly affect or render impossible the safe execution of SUMMERCAMP 2026 or parts of it, the organiser may modify, shorten, interrupt, postpone or cancel the event or individual programme items (e.g. group rides, gravel tour, runs, lake sessions, parties). RAD RACE

2. The organiser is not liable for damages resulting solely from such modifications, interruptions or cancellations, except in cases of intentional or grossly negligent conduct.

3. Any refund or credit of participation fees in such situations will be handled in accordance with the organiser’s General Terms & Conditions and applicable statutory provisions. RAD RACE

10. Media and image rights

1. By participating in SUMMERCAMP 2026, participants consent, without compensation, to the recording and use of photos, video footage, audio recordings and interviews of them in connection with the event.

2. These materials may be used, edited and distributed by RAD RACE GmbH and selected partners for editorial and advertising purposes in all media (including print, online, social media, film, radio and TV), in each case in compliance with applicable data protection law. RAD RACE

3. Names and other event-related data (e.g. participation lists, activities, challenges) may be published on www.rad-race.com and in accompanying coverage.

11. Age requirements

1. As a rule, participants must be at least 18 years old at the start of SUMMERCAMP 2026.

2. Participants who are at least 16 but under 18 years of age may only participate with the prior written consent of a parent or legal guardian. The signed consent form must be provided to the organiser before the start of the event.

3. The organiser reserves the right to exclude participants who provide false information regarding their age or other registration data.

12. Final provisions

1. This disclaimer is governed by German law. Mandatory consumer protection provisions of the participant’s home country remain unaffected where they apply.

2. Should any provision of this disclaimer be or become invalid, the validity of the remaining provisions shall not be affected. In such a case, the invalid provision shall be replaced by a valid provision that most closely reflects the economic intent of the invalid provision.

3. This disclaimer forms an integral part of the participation agreement for SUMMERCAMP 2026 alongside the organiser’s General Terms & Conditions and event rules. RAD RACE

Dieser Haftungsausschluss wird zur besseren Verständlichkeit in englischer und deutscher Sprache bereitgestellt. Maßgeblich ist im Zweifel die deutsche Fassung.

Mit dem Betreten des Veranstaltungsgeländes und/oder der Teilnahme am RAD RACE SUMMERCAMP 2026 („SUMMERCAMP 2026“) erkennen alle Teilnehmenden und Besuchenden den folgenden Haftungsausschluss und die Teilnahmebedingungen an. Zusätzlich gelten die Allgemeinen Geschäftsbedingungen für Events der RAD RACE GmbH. RAD RACE

1. Teilnahme und eigenes Risiko

1. Die Teilnahme am SUMMERCAMP 2026 (einschließlich aller offiziellen Gruppenausfahrten, Gravel-Rides, Läufe, Badeaktivitäten, Workshops, Partys und sonstiger Programmpunkte) erfolgt auf eigenes Risiko der Teilnehmenden.

2. Hierdurch werden weder die nachstehenden Haftungsregelungen des Veranstalters (Ziffer 2) noch zwingende gesetzliche Verbraucherrechte eingeschränkt.

2. Haftung des Veranstalters

1. Veranstalter des SUMMERCAMP 2026 ist die RAD RACE GmbH („Veranstalter“).

2. Der Veranstalter haftet unbeschränkt:

   • für Schäden, die auf einer vorsätzlichen oder grob fahrlässigen Pflichtverletzung des Veranstalters oder eines gesetzlichen Vertreters oder Erfüllungsgehilfen beruhen, und

   • für Schäden aus der Verletzung von Leben, Körper oder Gesundheit, die auf einer fahrlässigen oder vorsätzlichen Pflichtverletzung des Veranstalters oder eines gesetzlichen Vertreters oder Erfüllungsgehilfen beruhen.

3. Für sonstige Schäden, die auf einer einfach fahrlässigen Pflichtverletzung beruhen, haftet der Veranstalter nur bei Verletzung wesentlicher Vertragspflichten („Kardinalpflichten“). In diesen Fällen ist die Haftung der Höhe nach auf den bei Vertragsschluss typischerweise vorhersehbaren Schaden begrenzt. Wesentliche Vertragspflichten sind solche Pflichten, deren Erfüllung die ordnungsgemäße Durchführung der Veranstaltung überhaupt erst ermöglicht und auf deren Einhaltung die Teilnehmenden regelmäßig vertrauen dürfen.

4. Im Übrigen ist die Haftung des Veranstalters ausgeschlossen. Zwingende gesetzliche Haftungsvorschriften (insbesondere nach dem Produkthaftungsgesetz) bleiben unberührt.

3. Gesundheitszustand, Fitness und Eigenverantwortung

1. Jede teilnehmende Person ist selbst dafür verantwortlich, dass ihr körperlicher und psychischer Zustand eine sichere Teilnahme an einem mehrtägigen Radsport-, Lauf- und Outdoor-Camp ermöglicht, insbesondere in Bezug auf:

   • längere An- und Abfahrten mit dem Rad,

   • Gravel-Passagen,

   • Community Runs,

   • Schwimmen im offenen Gewässer (See),

   • Hitze, Kälte und wechselnde Witterung,

   • späte Abende und ggf. Alkoholkonsum.

2. Es wird empfohlen, vor Teilnahme eine ärztliche Untersuchung durchführen zu lassen und ärztlichen Rat zu befolgen.

3. Teilnehmende mit Vorerkrankungen (z. B. Herz-Kreislauf-Erkrankungen, Atemwegserkrankungen, Epilepsie, frische Verletzungen oder ähnliche Einschränkungen) haben eigenverantwortlich zu klären, ob eine Teilnahme für sie vertretbar ist.

4. Teilnehmende sind verpflichtet, den Veranstalter bzw. die Crew unverzüglich zu informieren, wenn sie sich unwohl fühlen oder sich nicht mehr in der Lage sehen, sicher teilzunehmen.

4. Straßenverkehr und Verkehrssicherheit

1. Die Gruppenausfahrten (An- und Abfahrt von/nach Berlin / Hamburg) sowie alle Fahrten und Läufe während des SUMMERCAMP 2026 finden überwiegend auf öffentlichen Straßen und Wegen statt, die für den allgemeinen Verkehr geöffnet sind.

2. Die Teilnehmenden haben jederzeit die geltenden straßenverkehrsrechtlichen Vorschriften (insbesondere StVO / StVZO) einzuhalten und insbesondere:

   • Verkehrszeichen, Ampeln und behördliche Anordnungen zu beachten,

   • Vorfahrtsregeln einzuhalten,

   • im Gruppenverband, bei Abfahrten, im Stadtverkehr und auf Gravel-Passagen besonders vorausschauend und defensiv zu fahren bzw. zu laufen.

3. Den Teilnehmenden ist bewusst, dass die Missachtung von Verkehrsregeln und Anweisungen das Risiko von Unfällen und schweren Verletzungen erheblich erhöht.

4. Für Verletzungen von Leben, Körper oder Gesundheit, die ausschließlich auf der Missachtung der geltenden Verkehrsregeln oder behördlicher Anordnungen durch Teilnehmende beruhen, haftet der Veranstalter nur im Rahmen der Regelungen in Ziffer 2.

5. Campingplatz, See und Unterkunft

1. Das SUMMERCAMP 2026 findet auf dem Campingplatz Friedensteich Wittenberge (Wüstenweg 13a, 19322 Wittenberge, Deutschland) statt. Neben diesem Haftungsausschluss gelten die jeweiligen Regeln und Nutzungsbedingungen des Campingplatzbetreibers.

2. Der See sowie weitere Naturbereiche des Geländes werden nicht jederzeit durch Rettungsschwimmer oder Sicherheitspersonal überwacht. Schwimmen und sonstige Wasseraktivitäten erfolgen auf eigenes Risiko.

3. Teilnehmende haben sich so zu verhalten, dass sie weder sich selbst noch andere im oder am Wasser gefährden, insbesondere indem sie:

   • nicht unter Alkohol- oder Drogeneinfluss schwimmen,

   • gekennzeichnete Badezonen und Warnhinweise beachten,

   • nicht in unbekannte oder flache Bereiche springen oder hineinspringen lassen.

4. Für von Teilnehmenden verursachte Schäden an Unterkünften (Cabins, Zelten, Mietzelten), Sanitäranlagen oder sonstiger Infrastruktur können der Veranstalter und/oder der Campingplatzbetreiber Ersatz verlangen.

5. Der Veranstalter haftet nicht für Diebstahl oder Verlust von persönlichen Gegenständen (z. B. Fahrräder, Ausrüstung, Zelte, technische Geräte, Kleidung, Wertsachen), soweit dem Veranstalter nicht nach Maßgabe von Ziffer 2 ein Verschulden zur Last fällt.

6. Ausrüstung, Fahrräder und Sicherheitsausstattung

1. Jede teilnehmende Person ist für den verkehrs- und betriebssicheren Zustand ihres Fahrrads (Rahmen, Bremsen, Lenkung, Reifen, Beleuchtung etc.) selbst verantwortlich.

2. Das Tragen eines geeigneten Fahrradhelms ist bei allen offiziellen Ausfahrten verpflichtend und wird darüber hinaus für alle Fahrten während des Wochenendes dringend empfohlen.

3. In der Dämmerung und bei schlechter Sicht wird die Nutzung von Beleuchtung und reflektierender Kleidung dringend empfohlen.

4. Der vor Ort angebotene mechanische Support sowie Park Tool School Sessions stellen freiwillige Serviceleistungen dar. Die Teilnahme hieran entbindet die Teilnehmenden nicht von der eigenen Verantwortung für den Zustand ihres Fahrrads.

5. Persönliche Medikamente und individuell benötigte Sicherheitsausrüstung (z. B. Allergiemedikamente, orthopädische Hilfsmittel) sind von den Teilnehmenden selbst mitzubringen.

7. Regeln, Anweisungen und Ausschluss von der Veranstaltung

1. Die Teilnehmenden verpflichten sich, die auf der Website des Veranstalters veröffentlichten sowie vor und während der Veranstaltung kommunizierten Regeln einzuhalten. RAD RACE

2. Den Anweisungen des Veranstalters, der Crew, der Guides, des Sicherheitspersonals, des medizinischen Personals sowie des Campingplatzbetreibers ist jederzeit Folge zu leisten.

3. Der Veranstalter ist berechtigt, Teilnehmende ganz oder teilweise – vorübergehend oder dauerhaft – von der Veranstaltung auszuschließen, insbesondere wenn:

   • sicherheitsrelevante Anweisungen missachtet werden,

   • es zu schweren oder wiederholten Verstößen gegen Regeln oder diesen Haftungsausschluss kommt,

   • das Verhalten andere Teilnehmende, Mitarbeitende oder Dritte gefährdet,

   • es zu erheblichen Ruhestörungen oder Störungen des Betriebs des Campingplatzes kommt,

   • die betreffende Person erkennbar in einem Maße unter Alkohol- oder Drogeneinfluss steht, das eine sichere Teilnahme ausschließt.

4. In diesen Fällen besteht kein Anspruch auf Rückerstattung von Teilnahmegebühren oder sonstigen Kosten (z. B. Anreise, Unterkunft).

8. Umweltverantwortung

1. Die RAD RACE GmbH fördert umweltbewusstes Handeln in allen Geschäftsbereichen und Events. RAD RACE

2. Die Teilnehmenden verpflichten sich, Natur und Umwelt rund um den Friedensteich zu schützen, insbesondere indem sie:

   • Abfälle vermeiden und bereitgestellte Abfall- und Recyclingbehälter nutzen,

   • Vegetation und Tierwelt schonen,

   • Lärm- und Lichtemissionen auf ein zumutbares Maß begrenzen,

   • Wasser- und Energieressourcen sparsam verwenden.

3. Nachgewiesene schwerwiegende oder wiederholte Verstöße gegen Umweltregeln können zum Ausschluss von der Veranstaltung und gegebenenfalls zu Schadensersatzansprüchen führen.

9. Höhere Gewalt und Programmänderungen

1. Bei Ereignissen höherer Gewalt (u. a. Unwetter, Sturm, Hochwasser, Brand, Naturkatastrophen, Epidemien, behördliche Anordnungen, Straßensperrungen oder sonstige außerhalb des zumutbaren Einflussbereichs des Veranstalters liegende Umstände), die die sichere Durchführung des SUMMERCAMP 2026 oder einzelner Programmpunkte wesentlich beeinträchtigen oder unmöglich machen, ist der Veranstalter berechtigt, die Veranstaltung oder Teile davon zu ändern, zu kürzen, zu unterbrechen, zu verschieben oder abzusagen. 2. Der Veranstalter haftet für Schäden, die ausschließlich aus solchen Programmänderungen, Unterbrechungen oder Absagen resultieren, nur bei Vorsatz oder grober Fahrlässigkeit.

3. Eine etwaige Erstattung oder Gutschrift von Teilnahmegebühren in solchen Fällen richtet sich nach den Allgemeinen Geschäftsbedingungen des Veranstalters sowie den jeweils anwendbaren gesetzlichen Bestimmungen. RAD RACE

10. Medien- und Bildrechte

1. Mit ihrer Teilnahme erklären sich die Teilnehmenden damit einverstanden, dass im Zusammenhang mit ihrer Teilnahme am SUMMERCAMP 2026 erstellte Fotos, Videoaufnahmen, Tonaufnahmen und Interviews unentgeltlich aufgezeichnet, genutzt, bearbeitet und veröffentlicht werden dürfen.

2. Die Nutzung kann durch die RAD RACE GmbH und ausgewählte Partner für redaktionelle und werbliche Zwecke in allen Medien (insbesondere Print, Online, Social Media, Film, Hörfunk und TV) erfolgen, jeweils unter Beachtung der geltenden datenschutzrechtlichen Vorgaben. RAD RACE

3. Namen und weitere veranstaltungsbezogene Daten (z. B. Teilnahme- und Aktivitätslisten) dürfen auf www.rad-race.com sowie in begleitender Berichterstattung veröffentlicht werden.

11. Altersvorgaben

1. Grundsätzlich müssen Teilnehmende zu Beginn des SUMMERCAMP 2026 mindestens 18 Jahre alt sein.

2. Teilnehmende, die zu diesem Zeitpunkt mindestens 16, aber noch nicht 18 Jahre alt sind, dürfen nur mit vorheriger schriftlicher Einwilligung einer erziehungsberechtigten Person teilnehmen. Die unterschriebene Einwilligung ist dem Veranstalter vor Beginn der Veranstaltung vorzulegen.

3. Der Veranstalter behält sich das Recht vor, Teilnehmende zu disqualifizieren oder von der Teilnahme auszuschließen, die falsche Angaben zu ihrem Alter oder anderen Registrierungsdaten machen.

12. Schlussbestimmungen

1. Dieser Haftungsausschluss unterliegt deutschem Recht. Zwingende Verbraucherschutzvorschriften des Heimatstaates der teilnehmenden Person bleiben unberührt, soweit sie Anwendung finden.

2. Sollte eine Bestimmung dieses Haftungsausschlusses ganz oder teilweise unwirksam sein oder werden, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt. Anstelle der unwirksamen Bestimmung gilt eine wirksame Regelung als vereinbart, die dem wirtschaftlichen Zweck der unwirksamen Bestimmung am nächsten kommt.

3. Dieser Haftungsausschluss ist Bestandteil des Teilnahmevertrags für das SUMMERCAMP 2026 und gilt ergänzend zu den Allgemeinen Geschäftsbedingungen und Veranstaltungsregeln des Veranstalters. RAD RACE

By entering the event site and/or participating in RAD RACE SUMMERCAMP 2026 (“SUMMERCAMP 2026”), all participants and visitors accept the following disclaimer and terms of participation. The RAD RACE General Terms & Conditions for events apply in addition to this disclaimer.

1. Participation and own risk

1. Participation in SUMMERCAMP 2026 (including all official group rides, gravel rides, runs, lake activities, workshops, parties and all side events) takes place at the participant’s own risk.

2. This principle does not limit the organiser’s liability as set out in section 2 below or mandatory statutory rights of consumers.

2. Liability of the organiser

1. The organiser of SUMMERCAMP 2026 is RAD RACE GmbH (“organiser”).

2. The organiser is liable without limitation:

   • for damage caused intentionally or by gross negligence by the organiser, its legal representatives or vicarious agents, and

   • for damage resulting from injury to life, body or health, where such damage is caused by a negligent or intentional breach of duty by the organiser, its legal representatives or vicarious agents.

3. For other damage caused by simple (ordinary) negligence, the organiser is only liable in the event of a breach of essential contractual obligations (“cardinal duties”). In such cases, liability is limited to typical damage which was foreseeable at the time of conclusion of the contract. Essential contractual obligations are those whose fulfilment is a prerequisite for the proper performance of the event and on which participants regularly rely.

4. Any further liability of the organiser is excluded. Mandatory statutory liability (including, but not limited to, German product liability law) remains unaffected.

3. Health, fitness, insurance and personal responsibility

1. Each participant is solely responsible for ensuring that their physical and mental condition allows safe participation in a multi-day cycling, running and outdoor camp including, in particular:

   • long-distance rides to and from the camp,

   • gravel sections,

   • community runs,

   • open-water swimming in a lake,

   • heat, cold, weather changes, and

   • late nights and possible alcohol consumption.

2. Participants are advised to undergo a medical check-up before participating and to follow medical advice.

3. Participants with health issues (e.g. cardiovascular conditions, respiratory problems, epilepsy, recent injuries, or similar conditions) must clarify with a doctor whether participation is safe for them.

4. Participants must immediately inform the organiser or crew if they feel unwell or no longer capable of participating safely.

5. Participants must not take part in rides, runs, swimming or any other water activities while under the influence of alcohol, illegal drugs or medication that may impair their ability to participate safely.

6. Participants are required to have valid personal liability insurance (Haftpflichtversicherung) that covers damage they may cause to third parties during SUMMERCAMP 2026. The organiser may request proof of such insurance. The organiser also strongly recommends that participants take out appropriate health and accident insurance, including coverage for sports activities and, where applicable, travel.

4. Traffic regulations and road safety

1. SUMMERCAMP 2026 group rides (to and from Berlin/Hamburg) and any rides or runs during the weekend take place on public roads and paths that are open to general traffic.

2. Participants must comply with all applicable traffic regulations at all times (in particular the German Road Traffic Act and Road Traffic Regulations) and must:

   • obey traffic signs, traffic lights and instructions by police or authorities,

   • respect right-of-way rules,

   • ride/run in a controlled manner, especially in groups, on descents, in urban areas and on gravel sections.

3. Participants acknowledge that non-compliance with traffic regulations and instructions significantly increases the risk of accidents and serious injuries.

4. The organiser is not liable for damage to life, body or health that is solely caused by a participant’s disregard of applicable traffic regulations or official instructions, subject to section 2 above.

5. Participants must in particular refrain from riding a bike under the influence of alcohol, illegal drugs or medication that may impair their ability to safely take part in road traffic.

5. Campground, lake and accommodation

1. SUMMERCAMP 2026 takes place at the Friedensteich Wittenberge camping ground (Wüstenweg 13a, 19322 Wittenberge, Germany). Participants must respect all rules and regulations of the campground operator in addition to this disclaimer.

2. Participants must comply with all bathing rules and safety instructions issued by the campground and lake operator.

3. The lake and other natural areas around the campground are not necessarily supervised by lifeguards or safety staff at all times. Swimming and all water activities are undertaken at each participant’s own risk. Participants must behave in a way that does not endanger themselves or others in or around the water, in particular by:

   • refraining from entering the water under the influence of alcohol, illegal drugs or similar substances,

   • respecting marked swimming zones and warnings,

   • not jumping or diving into unknown or shallow water.

4. Participants are responsible for any damage they cause to accommodation (cabins, tents, rental tents), sanitary facilities or other infrastructure and may be held liable by the organiser, the campground operator and/or partners and service providers (e.g. tent rental services).

5. The organiser is not liable for theft or loss of personal belongings, including but not limited to bikes, equipment, tents, technical devices, clothing or valuables, unless otherwise required by law or covered under section 2.

6. Equipment, bikes and safety gear

1. Every participant is responsible for ensuring that their bike is in proper, roadworthy and safe condition (frame, brakes, steering, tyres, lights, etc.).

2. Helmets are mandatory on all official rides and strongly recommended when cycling at any time during the weekend.

3. The use of lights and reflective clothing is strongly recommended in low light or poor visibility conditions.

4. Mechanical support and Park Tool School sessions provided on site are intended as voluntary, supportive services only. Participation in such sessions does not transfer responsibility for the roadworthiness of the bike from the participant to the organiser or partner brands.

5. Participants must bring any personal medication and specific safety equipment they require (e.g. allergy medication, orthopaedic aids, etc.).

7. Rules, instructions and exclusion from the event

1. Participants must comply with all rules and information published on the organiser’s website and communicated before or during the event.

2. Participants must follow instructions given by the organiser, crew members, guides, security staff, medical staff and the campground operator at all times.

3. The organiser reserves the right to exclude participants from parts of the programme or the entire event, temporarily or permanently, in particular if:

   • safety-relevant instructions are ignored,

   • there are serious or repeated breaches of rules or of this disclaimer,

   • behaviour endangers other participants, staff or third parties,

   • participants cause significant disturbance (e.g. at night, at the lake, in cabins or tents),

   • participants are obviously under the influence of alcohol or drugs in a way that poses a safety risk.

4. In such cases, there is no entitlement to a refund of participation fees or other costs (e.g. travel, accommodation).

8. Environmental responsibility

1. RAD RACE promotes environmentally responsible behaviour at all events.

2. Participants undertake to protect the nature around Friedensteich, in particular by:

   • avoiding littering and using designated waste and recycling bins,

   • protecting vegetation and wildlife,

   • avoiding unnecessary noise and light pollution,

   • using water and energy resources responsibly.

3. Proven serious or repeated infringements of environmental rules may lead to exclusion from the event and, where applicable, claims for damages.

9. Force majeure and event changes

1. In cases of force majeure (including but not limited to severe weather, storms, floods, fire, natural disasters, epidemics, official orders, road closures or other events beyond the organiser’s reasonable control) that significantly affect or render impossible the safe execution of SUMMERCAMP 2026 or parts of it, the organiser may modify, shorten, interrupt, postpone or cancel the event or individual programme items (e.g. group rides, gravel tour, runs, lake sessions, parties).

2. The organiser is not liable for damages resulting solely from such modifications, interruptions or cancellations, except in cases of intentional or grossly negligent conduct.

3. Any refund or credit of participation fees in such situations will be handled in accordance with the organiser’s General Terms & Conditions and applicable statutory provisions.

10. Media and image rights

1. By participating in SUMMERCAMP 2026, participants consent, without compensation, to the recording and use of photos, video footage, audio recordings and interviews of them in connection with the event.

2. These materials may be used, edited and distributed by RAD RACE GmbH and selected partners for editorial and advertising purposes in all media (including print, online, social media, film, radio and TV), in each case in compliance with applicable data protection law.

3. Names and other event-related data (e.g. participation lists, activities, challenges) may be published on www.rad-race.com and in accompanying coverage.

11. Age requirements

1. As a rule, participants must be at least 18 years old at the start of SUMMERCAMP 2026.

2. Participants who are at least 16 but under 18 years of age may only participate with the prior written consent of a parent or legal guardian. The signed consent form must be provided to the organiser before the start of the event.

3. The organiser reserves the right to exclude participants who provide false information regarding their age or other registration data.

12. Final provisions

1. This disclaimer is governed by German law. Mandatory consumer protection provisions of the participant’s home country remain unaffected where they apply.

2. Should any provision of this disclaimer be or become invalid, the validity of the remaining provisions shall not be affected. In such a case, the invalid provision shall be replaced by a valid provision that most closely reflects the economic intent of the invalid provision.

3. This disclaimer forms an integral part of the participation agreement for SUMMERCAMP 2026 alongside the organiser’s General Terms & Conditions and event rules.

Dieser Haftungsausschluss wird zur besseren Verständlichkeit in englischer und deutscher Sprache bereitgestellt. Maßgeblich ist im Zweifel die deutsche Fassung.

Mit dem Betreten des Veranstaltungsgeländes und/oder der Teilnahme am RAD RACE SUMMERCAMP 2026 („SUMMERCAMP 2026“) erkennen alle Teilnehmenden und Besuchenden den folgenden Haftungsausschluss und die Teilnahmebedingungen an. Zusätzlich gelten die Allgemeinen Geschäftsbedingungen für Events der RAD RACE GmbH.

1. Teilnahme und eigenes Risiko

1. Die Teilnahme am SUMMERCAMP 2026 (einschließlich aller offiziellen Gruppenausfahrten, Gravel-Rides, Läufe, Badeaktivitäten, Workshops, Partys und sonstiger Programmpunkte) erfolgt auf eigenes Risiko der Teilnehmenden.

2. Hierdurch werden weder die nachstehenden Haftungsregelungen des Veranstalters (Ziffer 2) noch zwingende gesetzliche Verbraucherrechte eingeschränkt.

2. Haftung des Veranstalters

1. Veranstalter des SUMMERCAMP 2026 ist die RAD RACE GmbH („Veranstalter“).

2. Der Veranstalter haftet unbeschränkt:

   • für Schäden, die auf einer vorsätzlichen oder grob fahrlässigen Pflichtverletzung des Veranstalters oder eines gesetzlichen Vertreters oder Erfüllungsgehilfen beruhen, und

   • für Schäden aus der Verletzung von Leben, Körper oder Gesundheit, die auf einer fahrlässigen oder vorsätzlichen Pflichtverletzung des Veranstalters oder eines gesetzlichen Vertreters oder Erfüllungsgehilfen beruhen.

3. Für sonstige Schäden, die auf einer einfach fahrlässigen Pflichtverletzung beruhen, haftet der Veranstalter nur bei Verletzung wesentlicher Vertragspflichten („Kardinalpflichten“). In diesen Fällen ist die Haftung der Höhe nach auf den bei Vertragsschluss typischerweise vorhersehbaren Schaden begrenzt. Wesentliche Vertragspflichten sind solche Pflichten, deren Erfüllung die ordnungsgemäße Durchführung der Veranstaltung überhaupt erst ermöglicht und auf deren Einhaltung die Teilnehmenden regelmäßig vertrauen dürfen.

4. Im Übrigen ist die Haftung des Veranstalters ausgeschlossen. Zwingende gesetzliche Haftungsvorschriften (insbesondere nach dem Produkthaftungsgesetz) bleiben unberührt.

3. Gesundheitszustand, Versicherung, Fitness und Eigenverantwortung

1. Jede teilnehmende Person ist selbst dafür verantwortlich, dass ihr körperlicher und psychischer Zustand eine sichere Teilnahme an einem mehrtägigen Radsport-, Lauf- und Outdoor-Camp ermöglicht, insbesondere in Bezug auf:

   • längere An- und Abfahrten mit dem Rad,

   • Gravel-Passagen,

   • Community Runs,

   • Schwimmen im offenen Gewässer (See),

   • Hitze, Kälte und wechselnde Witterung,

   • späte Abende und ggf. Alkoholkonsum.

2. Es wird empfohlen, vor Teilnahme eine ärztliche Untersuchung durchführen zu lassen und ärztlichen Rat zu befolgen.

3. Teilnehmende mit Vorerkrankungen (z. B. Herz-Kreislauf-Erkrankungen, Atemwegserkrankungen, Epilepsie, frische Verletzungen oder ähnliche Einschränkungen) haben eigenverantwortlich zu klären, ob eine Teilnahme für sie vertretbar ist.

4. Teilnehmende sind verpflichtet, den Veranstalter bzw. die Crew unverzüglich zu informieren, wenn sie sich unwohl fühlen oder sich nicht mehr in der Lage sehen, sicher teilzunehmen.

5. Teilnehmende dürfen nicht an Ausfahrten, Läufen, Schwimm- oder sonstigen Wasseraktivitäten teilnehmen, wenn sie unter dem Einfluss von Alkohol, illegalen Drogen oder Medikamenten stehen, die ihre sichere Teilnahme beeinträchtigen können.

6. Die Teilnehmenden sind verpflichtet, eine gültige private Haftpflichtversicherung zu unterhalten, die von ihnen verursachte Personen- und Sachschäden gegenüber Dritten während des SUMMERCAMP 2026 abdeckt. Der Veranstalter kann einen entsprechenden Nachweis verlangen. Zudem wird der Abschluss einer geeigneten Kranken- und Unfallversicherung, einschließlich einer Absicherung von Sportaktivitäten und ggf. einer Auslandsreiseversicherung, dringend empfohlen.

4. Straßenverkehr und Verkehrssicherheit

1. Die Gruppenausfahrten (An- und Abfahrt von/nach Berlin / Hamburg) sowie alle Fahrten und Läufe während des SUMMERCAMP 2026 finden überwiegend auf öffentlichen Straßen und Wegen statt, die für den allgemeinen Verkehr geöffnet sind.

2. Die Teilnehmenden haben jederzeit die geltenden straßenverkehrsrechtlichen Vorschriften (insbesondere StVO / StVZO) einzuhalten und insbesondere:

   • Verkehrszeichen, Ampeln und behördliche Anordnungen zu beachten,

   • Vorfahrtsregeln einzuhalten,

   • im Gruppenverband, bei Abfahrten, im Stadtverkehr und auf Gravel-Passagen besonders vorausschauend und defensiv zu fahren bzw. zu laufen.

3. Den Teilnehmenden ist bewusst, dass die Missachtung von Verkehrsregeln und Anweisungen das Risiko von Unfällen und schweren Verletzungen erheblich erhöht.

4. Für Verletzungen von Leben, Körper oder Gesundheit, die ausschließlich auf der Missachtung der geltenden Verkehrsregeln oder behördlicher Anordnungen durch Teilnehmende beruhen, haftet der Veranstalter nur im Rahmen der Regelungen in Ziffer 2.

5. Insbesondere haben Teilnehmende davon abzusehen, ein Fahrrad unter dem Einfluss von Alkohol, illegalen Drogen oder Medikamenten zu führen, die ihre Fahrsicherheit beeinträchtigen können.

5. Campingplatz, See und Unterkunft

1. Das SUMMERCAMP 2026 findet auf dem Campingplatz Friedensteich Wittenberge (Wüstenweg 13a, 19322 Wittenberge, Deutschland) statt. Neben diesem Haftungsausschluss gelten die jeweiligen Regeln und Nutzungsbedingungen des Campingplatzbetreibers.

2. Die jeweils gültigen Baderegeln und Sicherheitsanweisungen des Campingplatz- und Seebetreibers sind zwingend zu beachten.

3. Der See sowie weitere Naturbereiche des Geländes werden nicht jederzeit durch Rettungsschwimmer oder Sicherheitspersonal überwacht. Schwimmen und sonstige Wasseraktivitäten erfolgen auf eigenes Risiko. Teilnehmende haben sich so zu verhalten, dass sie weder sich selbst noch andere im oder am Wasser gefährden, insbesondere indem sie:

   • nicht unter Alkohol- oder Drogeneinfluss ins Wasser gehen,

   • gekennzeichnete Badezonen und Warnhinweise beachten,

   • nicht in unbekannte oder flache Bereiche springen oder hineinspringen lassen.

4. Für von Teilnehmenden verursachte Schäden an Unterkünften (Cabins, Zelten, Mietzelten), Sanitäranlagen oder sonstiger Infrastruktur können der Veranstalter, der Campingplatzbetreiber und/oder Partner und Dienstleister (z. B. Zeltvermietungen) Ersatz verlangen.

5. Der Veranstalter haftet nicht für Diebstahl oder Verlust von persönlichen Gegenständen (z. B. Fahrräder, Ausrüstung, Zelte, technische Geräte, Kleidung, Wertsachen), soweit dem Veranstalter nicht nach Maßgabe von Ziffer 2 ein Verschulden zur Last fällt.

6. Ausrüstung, Fahrräder und Sicherheitsausstattung

1. Jede teilnehmende Person ist für den verkehrs- und betriebssicheren Zustand ihres Fahrrads (Rahmen, Bremsen, Lenkung, Reifen, Beleuchtung etc.) selbst verantwortlich.

2. Das Tragen eines geeigneten Fahrradhelms ist bei allen offiziellen Ausfahrten verpflichtend und wird darüber hinaus für alle Fahrten während des Wochenendes dringend empfohlen.

3. In der Dämmerung und bei schlechter Sicht wird die Nutzung von Beleuchtung und reflektierender Kleidung dringend empfohlen.

4. Der vor Ort angebotene mechanische Support sowie Park Tool School Sessions stellen freiwillige Serviceleistungen dar. Die Teilnahme hieran entbindet die Teilnehmenden nicht von der eigenen Verantwortung für den Zustand ihres Fahrrads.

5. Persönliche Medikamente und individuell benötigte Sicherheitsausrüstung (z. B. Allergiemedikamente, orthopädische Hilfsmittel) sind von den Teilnehmenden selbst mitzubringen.

7. Regeln, Anweisungen und Ausschluss von der Veranstaltung

1. Die Teilnehmenden verpflichten sich, die auf der Website des Veranstalters veröffentlichten sowie vor und während der Veranstaltung kommunizierten Regeln einzuhalten.

2. Den Anweisungen des Veranstalters, der Crew, der Guides, des Sicherheitspersonals, des medizinischen Personals sowie des Campingplatzbetreibers ist jederzeit Folge zu leisten.

3. Der Veranstalter ist berechtigt, Teilnehmende ganz oder teilweise – vorübergehend oder dauerhaft – von der Veranstaltung auszuschließen, insbesondere wenn:

   • sicherheitsrelevante Anweisungen missachtet werden,

   • es zu schweren oder wiederholten Verstößen gegen Regeln oder diesen Haftungsausschluss kommt,

   • das Verhalten andere Teilnehmende, Mitarbeitende oder Dritte gefährdet,

   • es zu erheblichen Ruhestörungen oder Störungen des Betriebs des Campingplatzes kommt,

   • die betreffende Person erkennbar in einem Maße unter Alkohol- oder Drogeneinfluss steht, das eine sichere Teilnahme ausschließt.

4. In diesen Fällen besteht kein Anspruch auf Rückerstattung von Teilnahmegebühren oder sonstigen Kosten (z. B. Anreise, Unterkunft).

8. Umweltverantwortung

1. Die RAD RACE GmbH fördert umweltbewusstes Handeln in allen Geschäftsbereichen und Events.

2. Die Teilnehmenden verpflichten sich, Natur und Umwelt rund um den Friedensteich zu schützen, insbesondere indem sie:

   • Abfälle vermeiden und bereitgestellte Abfall- und Recyclingbehälter nutzen,

   • Vegetation und Tierwelt schonen,

   • Lärm- und Lichtemissionen auf ein zumutbares Maß begrenzen,

   • Wasser- und Energieressourcen sparsam verwenden.

3. Nachgewiesene schwerwiegende oder wiederholte Verstöße gegen Umweltregeln können zum Ausschluss von der Veranstaltung und gegebenenfalls zu Schadensersatzansprüchen führen.

9. Höhere Gewalt und Programmänderungen

1. Bei Ereignissen höherer Gewalt (u. a. Unwetter, Sturm, Hochwasser, Brand, Naturkatastrophen, Epidemien, behördliche Anordnungen, Straßensperrungen oder sonstige außerhalb des zumutbaren Einflussbereichs des Veranstalters liegende Umstände), die die sichere Durchführung des SUMMERCAMP 2026 oder einzelner Programmpunkte wesentlich beeinträchtigen oder unmöglich machen, ist der Veranstalter berechtigt, die Veranstaltung oder Teile davon zu ändern, zu kürzen, zu unterbrechen, zu verschieben oder abzusagen.

2. Der Veranstalter haftet für Schäden, die ausschließlich aus solchen Programmänderungen, Unterbrechungen oder Absagen resultieren, nur bei Vorsatz oder grober Fahrlässigkeit.

3. Eine etwaige Erstattung oder Gutschrift von Teilnahmegebühren in solchen Fällen richtet sich nach den Allgemeinen Geschäftsbedingungen des Veranstalters sowie den jeweils anwendbaren gesetzlichen Bestimmungen.

10. Medien- und Bildrechte

1. Mit ihrer Teilnahme erklären sich die Teilnehmenden damit einverstanden, dass im Zusammenhang mit ihrer Teilnahme am SUMMERCAMP 2026 erstellte Fotos, Videoaufnahmen, Tonaufnahmen und Interviews unentgeltlich aufgezeichnet, genutzt, bearbeitet und veröffentlicht werden dürfen.

2. Die Nutzung kann durch die RAD RACE GmbH und ausgewählte Partner für redaktionelle und werbliche Zwecke in allen Medien (insbesondere Print, Online, Social Media, Film, Hörfunk und TV) erfolgen, jeweils unter Beachtung der geltenden datenschutzrechtlichen Vorgaben.

3. Namen und weitere veranstaltungsbezogene Daten (z. B. Teilnahme- und Aktivitätslisten) dürfen auf www.rad-race.com sowie in begleitender Berichterstattung veröffentlicht werden.

11. Altersvorgaben

1. Grundsätzlich müssen Teilnehmende zu Beginn des SUMMERCAMP 2026 mindestens 18 Jahre alt sein.

2. Teilnehmende, die zu diesem Zeitpunkt mindestens 16, aber noch nicht 18 Jahre alt sind, dürfen nur mit vorheriger schriftlicher Einwilligung einer erziehungsberechtigten Person teilnehmen. Die unterschriebene Einwilligung ist dem Veranstalter vor Beginn der Veranstaltung vorzulegen.

3. Der Veranstalter behält sich das Recht vor, Teilnehmende zu disqualifizieren oder von der Teilnahme auszuschließen, die falsche Angaben zu ihrem Alter oder anderen Registrierungsdaten machen.

12. Schlussbestimmungen

1. Dieser Haftungsausschluss unterliegt deutschem Recht. Zwingende Verbraucherschutzvorschriften des Heimatstaates der teilnehmenden Person bleiben unberührt, soweit sie Anwendung finden.

2. Sollte eine Bestimmung dieses Haftungsausschlusses ganz oder teilweise unwirksam sein oder werden, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt. Anstelle der unwirksamen Bestimmung gilt eine wirksame Regelung als vereinbart, die dem wirtschaftlichen Zweck der unwirksamen Bestimmung am nächsten kommt.

3. Dieser Haftungsausschluss ist Bestandteil des Teilnahmevertrags für das SUMMERCAMP 2026 und gilt ergänzend zu den Allgemeinen Geschäftsbedingungen und Veranstaltungsregeln des Veranstalters.

4. Letzte Aktualisierung: 11. Dezember 2025.

§ 1 General

(1) These general event conditions (“T&C”) apply to all cycling events (“event”) carried out by RAD RACE GmbH (“organiser”).

(2) By registration via the respective event website, these T&C form part of and govern the contractual relationship between the contractual partner and the organiser (“participation agreement”). The “contractual partner” and therefore the only party entitled to assert claims against the organiser is the party that acquires the event services via the respective event website; this applies explicitly even if the event services include entitlements to participate or other services in favour of third parties.

(3) An essential component of the participation agreement are the regulations (“RAD CODE” and “DISCLAIMER”) applicable for the respective event and accessible on the website. The contractual partner confirms that they have read the regulations applicable at the time of registration and, if they acquire event services for third parties, that they have made these regulations available to the individuals concerned prior to registration.

(4) The contractual partner acknowledges that a mandatory requirement for participation in the organiser’s events is the submission of a valid declaration of liability (disclaimer) for the respective event, as provided (unaltered) on the respective event website, including acknowledgement of the applicable regulations contained therein. The contractual partner shall ensure that the organiser has a declaration of liability signed by all individuals for whom the contractual partner acquires event services under the participation agreement at the latest upon accreditation. Individuals who have not submitted a declaration of liability will not be admitted to the event; the contractual partner shall not derive any rights or claims from this.

(5) The contractual partner guarantees that the information provided for all individuals during the registration process is correct and complete and that the individuals concerned fulfil the participation requirements as defined in the respective regulations.

§ 2 Event Services

(1) By registering on the respective event website and thereby concluding the participation agreement, the contractual partner acquires, for all individuals named in the registration, the right to participate in the respective event in accordance with these T&C and the applicable regulations, provided the required declarations of liability have been submitted.

(2) The respective event services are described on the relevant event website. After registering on the event website, the contractual partner receives a confirmation of registration.

(3) Except for the “RAD RACE LAST WO/MAN STANDING”, the organiser’s events are open-air events, which are exposed to the elements (weather conditions, etc.). The contractual partner acknowledges that the organiser cannot always influence conditions on site and that the organiser reserves the right to make adjustments to the contractual services for legitimate reasons (e.g. route changes), taking into account the participants’ interests in the best possible way.

(4) Event services are not transferable. Only those individuals named in the registration form are entitled to participate. By way of exception, a one-time substitution of a participant is possible upon written request by the contractual partner up to two weeks before the start of the event. For swapping riders after registration, a fee of EUR 10 will be charged. Special rules apply to the participants of “RAD RACE TOUR DE FRIENDS”: swapping team members or transferring the starting place to another person is possible up to eight weeks before the event; in this case a fee of EUR 30 will be charged.

(5) Event documents are handed over only upon presentation of the confirmation email (see § 3 (4)), the signed declaration of liability and an identity document (ID card or passport). If it is not possible to pick up the event documents personally, they may be handed over to an authorised third person upon presentation of a written authorisation. Event documents will not be shipped.

(6) The organiser uses transponders for timekeeping during “RAD RACE LAST WO/MAN STANDING”. Participants are obliged to handle the transponders with care and in accordance with the organiser’s instructions. By attending the event, the participant agrees to reimburse the value of the transponder (EUR 80) in case of loss or damage.

The organiser may use GPS devices to track individual participants and publish their position on www.rad-race.com during the following events: “RAD RACE TOUR DE FRIENDS”, “RAD RACE 96 HOURS” and “RAD CAMP”. Participants are obliged to handle the GPS devices with care and in accordance with the organiser’s instructions. By attending the event, the participant agrees to reimburse the value of the GPS device (EUR 170) in case of loss or damage.

§ 3 Services Provided, Payment Terms, and Confirmation of Participation

(1) For the event services, the contractual partner pays the fee specified during the registration process (“attendance fee”). This also applies explicitly to attendance fees that the contractual partner acquires on behalf of the third parties listed in the registration.

(2) Attendance fees are quoted inclusive of statutory VAT, where applicable.

(3) Payment of the attendance fee is made via PayPal®, Stripe® or other payment methods offered on the registration platform.

(4) Once all attendance fees have been paid in full, the contractual partner receives a confirmation from the organiser for each individual registered. The confirmation serves as proof that the organiser has received the attendance fees in full. The confirmation must be presented at the event venue for accreditation. Without this confirmation, individuals will not be admitted to the event, and the contractual partner shall not derive any rights or claims from this.

(5) Additional age-related or discounted categories (such as “under 30”) may be subject to specific conditions that will be communicated in the respective event information. Where proof of age or other eligibility is required, it must be provided within the period stated in the event information; otherwise, the discounted entry or special category may be cancelled or converted to a regular entry in accordance with the organiser’s conditions.

§ 4 Cancellation – Refund

(1) As a general rule, cancellation by the contractual partner with a refund of the attendance fee is not possible. If a participant is unable to attend the event, it is possible to transfer the participation to another person in accordance with § 2 (4).

(2) By purchasing a ticket (starting spot) for one of the organiser’s events, the contractual partner acknowledges that contractual cancellation rights exist only for the events “RAD RACE TOUR DE FRIENDS” and “RAD RACE 96 HOURS” and are governed as follows:

– If the organiser receives the written notice of cancellation at least six (6) months before the scheduled start date of the event, the organiser will refund 75% of the attendance fees.

– If the organiser receives the written notice of cancellation at least three (3) months but less than six (6) months before the scheduled start date of the event, the organiser will refund 50% of the attendance fees.

– If the organiser receives the written notice of cancellation less than three (3) months before the scheduled start date of the event, no cancellation is possible and no refund will be made.

The time of receipt of the written cancellation by the organiser is decisive for the calculation of the deadlines above.

For all other events of the organiser, there is no contractual right to cancellation with refund of attendance fees; § 2 (4) (participant substitution) remains unaffected.

(3) Refunds of the amounts to be reimbursed pursuant to § 4 (2) shall be made within 30 days of receipt of the cancellation notice by the organiser.

§ 5 Force Majeure

(1) If the event or individual stages are cancelled or abandoned due to force majeure, official orders, safety reasons or reasons for which the organiser is not responsible (e.g. another pandemic such as COVID-19), the organiser shall be released from its obligations to perform. The organiser is not liable for damages that the contractual partner or participants incur for this reason (e.g. travel and accommodation costs).

(2) If the event or individual stages are changed in venue and/or timing due to force majeure (e.g. bad weather) or other reasons for which the organiser is not responsible, the organiser shall be released from its obligations to perform in the originally agreed form. The organiser is not liable for damages that the contractual partner or participants incur for this reason (e.g. travel and accommodation costs).

(3) A refund of attendance fees in the cases described in § 5 (1) and (2) is excluded. In the event of a change in venue and/or time, the contractual partner and the participants are entitled to attend the rescheduled event.

§ 7 The Organizer’s Liability

(1) The organiser’s liability is limited as follows:

The organiser is liable without limitation for damages arising from injury to life, body or health which are based on a negligent or intentional breach of duty by the organiser or one of the organiser’s legal representatives or vicarious agents.

For other damages that are based on an intentional or grossly negligent breach of duty by the organiser or one of the organiser’s legal representatives or vicarious agents, the organiser’s liability is likewise unlimited in terms of cause and amount.

For other damages that are based on a merely negligent breach of duty by the organiser or one of the organiser’s legal representatives or vicarious agents, the organiser is liable only in the event of a breach of essential contractual obligations (“cardinal obligations”). In such cases, liability is limited to the replacement of the foreseeable damage typical for this type of contract at the time of conclusion of the contract. Cardinal obligations are those obligations whose fulfilment enables the proper execution of the contract in the first place and on whose compliance the contractual partner regularly relies.

(2) The contractual partner is expressly reminded that the organiser and/or its legal representatives or vicarious agents are not liable for damages for which they are not responsible. This applies, for example, to damages caused by riding errors or misconduct of other riders or by the fact that participants are wholly or partially prevented from taking part due to legal provisions and/or government directives.

(3) This limitation of liability also expressly applies to lost valuables, clothing and equipment and to damage to bicycles, in particular damage occurring during transport back after the event.

§ 8 Miscellaneous

(1) No verbal side agreements have been made. Additions and amendments to this participation agreement must be made in writing (not by email) in order to be valid. The same applies to any waiver of or deviation from this written form requirement.

(2) If individual provisions of this participation agreement should be or become invalid or if there is a regulatory gap, the participation agreement shall otherwise remain valid. The parties shall negotiate in good faith to replace the invalid or missing provision with a valid one that comes closest to the documented commercial intention of the parties.

(3) This agreement is subject exclusively to German law.
